SUBJ: STATE FIRE MARSHAL'S OFFICE
The Committee on Executive Reorganization has
recommended on page five of the enclosed report
that the State Fire Marshal's Office be transferred
to the Department of Public Safety. The Fire
Prevention Board would continue to set rules and
regulations for fire safety and fire protection.
The Committee suggests that consideration be given
to delegating to the State Building Board some of
the regulatory functions having to do with building
code inspection.
While the Committee feels this move should be done
through statute, it is concerned that such an
effort might fail. Two years ago when the Committee
first proposed this, there was such an outcry from
local fire departments that the Committee decided
not to pursue it at the time. If a bill were
introduced during this legislative session, there
would be a massive lobbying effort to oppose the
transfer. For these reasons the Committee decided
to recommend that you attempt to pursue this
transfer by means of Executive Order. I must add
that the Executive Order method would make it
difficult to delegate some responsibilities to the
Building Board.
Commissioner Lunnen called me several weeks ago at
your suggestion so that we might begin drafting the
Executive Order. I suggested that we not begin thi
until after the legislative Session. My reasoning \"
was that if any action to move the Office occurred \
during the Legislative Session, the local fire
departments would get legislation introduced to
prevent your moving it by Executive Order. Since t **)
