(WATER RATE INCREASE AMENDMENTS)

AN ACT AMENDING SECTION 10-8-22, UTAH CODE ANNOTATED 1953;
RELATING TO WATER RATES; PROVIDING PUBLIC HEARING
REQUIREMENTS AND PROCEDURES TO FIX OR CHANGE RATES; AND
ESTABLISHING THE BASIS FOR CHARGING DIFFERENT RATES FOR
WATER SERVICES IN-CITY AND OUT-OF-CITY.
Be it enacted by the Legislature of the State of Utah:
Section 1. Section 10-0-22, Utah Code Annotated 1953, is
amended to read:
10-8-22. (1) They may fix, after public hearing, the rates
to be paid for the use of water furnished by the city.
(?.) Ho increase in water charges or connection or pumping
fees shall be made until after a public hearing in which a
determination is made that an increase is justified.
(3) Whenever rates or charges differ between city
residents and water users residing outside of the boundaries of a
22 city using city water, any increased charges must be based on the
23 costs of service or other objective cost factors.
