Emergency Use of Public and Party Line Telephones

1 AN ACT PROVIDING FOR THE PROHIBITION OF  CONTINUED
2 USE OF A PARTY LINE OR PUBLIC PAY TELEPHONE WHEN
3 ANOTHER REQUIRES THE USE OF SUCH TELEPHONE IN AN
4 EMERGENCY SITUATION, AND PROVIDING  ANYONE VIO-
5 LATING ACT IS GUILTY OF A MISDEMEANOR.
Be it enacted by the Legislature of the State of Utah:
1 Section 1.    As used in this act:
2 (1)    The words "party line" mean a subscriber's  line telephone
3 circuit, consisting of two or more main telephone stations connected there-
4 with, each station with a distinctive ring or telephone number.
5 (2)    The word "emergency" means a situation in which property or
6 human life are in jeopardy and the prompt summoning of aid is essential.
7 Section 2.   Any person who willfully refuses to yield or surrender
8 the use of a party line or a public pay telephone to another person for
9 the purpose of permitting the other person to report a fire or summon
10 police, medical or other aid in case of emergency, is guilty of a misde-
11 mcanor.  This section shall not apply to persons using a party line or
12 public pay telephone for an emergency call.
13 Section 3.   Any person who asks for or requests the use of a party
14 line or a public pay telephone on the pretext that an emergency exists,
15 knowing that no emergency in fact exists, is guilty of a misdemeanor.
16 Section 4.    It is a defense to prosecution under this act that the
17 accused did not know of the existence of an emergency and was not
18 informed of the emergency at the time of the request to yield the use of
19 the telephone.
