AN ACT RELATING TO PUBLIC SCHOOLS; PROVIDING AN EXCEPTION FOR
THE STATE BOARD OF EDUCATION FROM THE POWER OF THE
DIRECTOR OF THE DIVISION OF FACILITIES CONSTRUCTION AND
MANAGEMENT TO ALLOCATE SPACE, ACQUIRE AND HOLD TITLE TO
PROPERTY, OR LEASE SPACE TO BE OCCUPIED BY THOSE
INSTITUTIONS.
THIS ACT AMENDS SECTION 63-1-38.8, UTAH CODE ANNOTATED 1953, AS
LAST AMENDED BY CHAPTER 294, LAWS OF UTAH 1983.
Be it enacted by the Legislature of the State of Utah:
Section 1. Section 63-1-38.8, Utah Code Annotated 1953,
as last amended by Chapter 294, Laws of Utah 1983, is amended
to read:
The director shall:
(1) Recommend rules and regulations for promulgation by
the executive director for the utilization and management of
facilities and grounds owned or occupied by the state for the
use of its departments and agencies;
(2) Supervise and control the allocation of space to the
various departments, commissions, institutions, and agencies in
the capitol, the state office building, and all other buildings
or space owned, leased, or rented by or to the state[?
however]. However, supervision and control of the legislative
area is reserved to the legislature, and of the judicial area
