The meeting was called to order at 1:00 P.M. The first order of business was an appeal
hearing Jess Green vs American Fork City. Mr. Brown opened for Jess Green. Mr.
Brown stated that Jess Green had requested a document faxed to attorney Kathryn
Collard from a fax machine located in the American Fork Police department that he
believed was a first draft of the Webber report. Mr. Brown then detailed the reasons
that Mr. Green wanted to obtain the document and his rationale for believing the
document should be public.
Mr. Bennett opened for American Fork City. Mr. Bennett stated that the appeal
concerned two separate sets of documents-the document faxed to Ms. Collard and
documents sent from Ms. Collard to various defendants in a federal lawsuit. Mr.
Bennett affirmed American Fork City's position that the documents do not exist and that
even if they existed, the fact that they were sent from a public fax does not make them
public documents.
Mr. Brown presented evidence for Jess Green. Mr. Green was called as a witness. Mr.
Green gave some background about his difficulties and conflicts with the American Fork
City Police Department. He also discussed an investigation of the American Fork City
Police Department and his belief that the first draft of the investigative report (hereafter
the Webber report) contained information about himself and his minor children. He then
